FieldBid Terms of Service

These Terms of Service ("Terms") constitute an end-user license agreement between you and FieldBid, a sole proprietorship owned by Berkecan Aydinsan ("FieldBid", "we", "us", "our"), and govern your use of the FieldBid mobile application ("App"). These Terms are between you and FieldBid only, and not with Apple Inc. ("Apple"). FieldBid, not Apple, is solely responsible for the App and its content.

1. Eligibility and account use

You must be legally capable of entering into a binding contract to use FieldBid. You are responsible for your device security, Apple ID account, and all activity performed through your device.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use FieldBid on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device you do not own or control, except that the App may be accessed by other accounts associated with the purchaser via Family Sharing or volume purchasing. You may not reverse engineer, decompile, resell, sublicense, or create derivative works of the App except as permitted by applicable law.

3. Subscription and billing

Some features require a paid subscription. Billing, free trials, renewals, cancellations, and refunds are handled by Apple through your App Store account and are subject to Apple Media Services Terms and Conditions. Subscription access may be interrupted if payment fails, expires, or is canceled.

4. Maintenance and support

FieldBid is solely responsible for providing maintenance and support services for the App, as described in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

5. User content and responsibility

You are solely responsible for data you enter into FieldBid, including estimate details, pricing, and client information. You represent that you have all necessary rights to that data and that your use of FieldBid complies with applicable law.

6. Data storage and backup

FieldBid is designed as an offline-first app and stores project data locally on your device. You are responsible for your own backup practices (including iCloud/device backups) and for maintaining access to your records.

FieldBid is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. FieldBid does not provide legal, tax, or accounting advice.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.

9. Product claims

FieldBid, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

10. Intellectual property

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, FieldBid, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

11. Legal compliance

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

When using the App, you agree to comply with all applicable third-party terms of agreement, including any wireless data service agreement with your mobile carrier.

12. Limitation of liability

To the fullest extent permitted by law, FieldBid and its operators are not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, or business opportunity arising from your use of the App.

13. Termination

These Terms remain in effect until terminated by you or us. You may stop using FieldBid at any time. We may suspend or terminate access if you materially violate these Terms or if required by law.

14. Third-party beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15. Governing law

These Terms are governed by the laws of Turkey, without regard to conflict of law rules.

16. Changes to these Terms

We may update these Terms over time. Updated versions will be posted at this URL with a revised effective date. Continued use of FieldBid after changes means you accept the revised Terms.
